Differentiated Instruction – Best Practices for Study Success.

The Multistate Bar Examination (MBE) is a tough exam.  Not only are applicants supposed to master 7 substantive areas of law, but they must also navigate the nuances within the law and implement an answer selection strategy all in under 2 minutes per question.  It is a test of endurance as well as a test of knowledge.  Proper preparation for this 200-question exam is crucial to MBE success.   

Consider for a moment that everyone has a different learning style.  

Some of us are visual learners while others are auditory learners with many other categories and combinations in between.  Some of us have executive functioning deficits while some of us find it harder to stay focused.  Some study better during the day while others burn the midnight oil.  We read at a different pace, and we absorb content at a different pace as well.  How then could a one size fits all MBE prep course possibly work?  The truth is, no, it cannot.  We are all familiar with the adage – practice makes perfect.  While part of that might be true, learning how to “do” the practice must come first.

The history of differentiated instruction goes all the way back to the era of one-room schoolhouses.  

One teacher with a classroom filled with different age groups and different levels of proficiency.  The teacher essentially had to teach to the individual student – not to the whole class.  Over the years we moved away from that model in the name of efficiency. Teachers could not sustain a model in which they would have to create a lesson plan for each student individually. Differentiated instruction however was then and still is the key to ensuring exam success.  Differentiated instruction considers an individual’s learning style before implementing a study plan.  Differentiated instruction works for everybody – not only those with identified or diagnosed learning disabilities.  Both neurotypical and neuro-diverse applicants benefit.
